Difference between GD and FIR

 



GD বা General Diary এবং FIR বা First Information Report এই শব্দ গুলির সঙ্গে আমরা সকলেই কম বেশী পরিচিত ৷ এই দুটি জিনিস একনয় ৷ আসুন দেখে নেওয়া যাক GD ও FIR এর মধ্যে পার্থক্য ৷
👉GD বা General Diary হল এমন একটি বই ( সাধারনত ১০০টি পাতা থাকে) যাতে একটি থানার প্রতিটি ঘটনার বিবরন থাকে ৷ যেমন সংশ্লিষ্ট থানার পুলিশ কর্মীদের যাওয়া আসা , চার্জগ্রহন, আসামীর অ্যারেস্ট ইত্যাদি দৈনন্দিন কাজকর্মের বিবরণ থাক GD Book এ ৷ এটি থানার কর্মীদের দ্বারা Maintain করা হয় ৷
👉 FIR বা First Information Report হল এমন একটি লিখিত বিবরণ যা যে কোনো সূত্র থেকে পাওয়া তথ্য ৷ FIR এ অভিযোগীকারী বা তথ্য প্রদানকারী সহি বা LTI থাকবে ৷ ৷ FIR এর একটি কপি সংশ্লিষ্ট ব্যক্তিকে বিনামূল্যে প্রদান করা হয়৷ অরিজন্যাল FIR টি কোর্টে পাঠানো ও একটি নির্দিষ্ট কেস শুরু হয় ৷
👉Police Act ধারা 88 এ GD বিষয়টি উল্লেখ আছে। FIR এর বিষয়টি ফৌজদারী কার্যবিধি ( CrPC) ধারা ১৬২ তে উল্লেখ আছে ৷
👉GD is a record of all important events which take place in a police station. e.g arrival and departure of police staff, handing over and taking over of charge, arrest of person, details of law and order duty.
👉 FIR is the first information that is received first in point of time which is either given in writing or is reduced to writing. The informant or complainant puts signature on it. On the other side there is no requirement of obtaining signature of complainant in the GD.
👉GD is the compliance of section 44 of Police Act whereas FIR is the compliance of  section 162 of CrPC.


👉Section 44 of Police Act

"44. Police-officers to keep diary.—It shall be the duty of every officer in charge of a police-station to keep a general diary in such form shall, from time to time, be prescribed by the [State Government] and to record therein all complaints and charges preferred, the names of all persons 
arrested, the names of the complainants, the offences charged against them, the weapons or property that shall have been taken from their possession or otherwise, and the names of the witnesses who shall have been examined. The Magistrate of the district shall be at liberty to call for and inspect such diary. "

👉 Section 162 of CrPC

"162. Statements to police not to be signed: Use of statements in evidence.
(1) No statement made by any person to a police officer in the course of an investigation under this Chapter, shall, if reduced to writing, be signed by the person making it; nor shall any such statement or any record thereof, whether in a police diary or otherwise, or any part of such statement or record, be used for any purpose, save as hereinafter provided, at any inquiry or trial in respect of any offence under investigation at the time when such statement was made:

Provided that when any witness is called for the prosecution in such inquiry or trial whose statement has been reduced into writing as aforesaid, any part of his statement, if duly proved, may be used by the accused, and with the permission of the Court, by the prosecution, to contradict such witness in the manner provided by section 145 of the Indian Evidence Act , 1872 (1 of 1872); and when any part of such statement is so used, any part thereof may also be used in the re-examination of such witness, but for the purpose only of explaining any matter referred to in his cross-examination.

(2) Nothing in this section shall be deemed to apply to any statement falling within the provisions of clause (1) of section 32 of the Indian Evidence Act, 1872 (1 of 1872); or to affect the provisions of section 27 of that Act.

Explanation.—An omission to state a fact or circumstance in the statement referred to in sub-section (1) may amount to contradiction if the same appears to be significant and otherwise relevant having regard to the context in which such omission occurs and whether any omission amounts to a contradiction in the particular context shall be a question of fact."

  1. What is CD ? very often I listen in the Court the Bench clerk says "Call for CD" .pls explain .

    1. CD or case diary is records of progress of investigation. It is maintained by IO or Investigating Officer. CD is compliance of section 172 of CrPC. IO notes down each and every step of investigation in CD. So it is very important for considering bail application as well as during the time of trial. This why Judge or Magistrate call for CD at any stage of hearing of the case.
