👉 মাতৃত্বকালীন ছুটি বা Maternity Leave আগে ছিল ১৩৫ দিন বর্তমানে এটি বর্ধিত করে সর্বাধিক ১৮০ দিন করা হয়েছে।

👉 মাতৃত্বকালীন ছুটির সময় কালকে Dies non হিসাবে বিবেচনা করা হবে না ও এই সময়কালকের ছুটিকে সবেতন ছুটি হিসেবে গণ্য করা হবে।

👉 রাজ্য সরকারের contractual কর্মীদের ক্ষেত্রেও এটি প্রযোজ্য হবে।

👉 Abortion বা Miscarriage এর ক্ষেত্রে ছুটির সর্বাধিক পরিমান ৪২ দিন ৷

MEMORANDUM


In terms of Memo No.7844-F dated 17.10.2008, female employees engaged on contract basis are entitled to get the benefit of maternity leave for a maximum period of 135 days with contractual remuneration as per terms and conditions of contract.


The matter of enhancement of the upper limit of maternity leave irrespective of the category of contractual employee was under consideration of the Government for sometime past. After careful consideration it has been decided that all categories of female contractual employee including female software personnel engaged directly by State Government Departments / Directorates in terms of Memo No.5859-F[Y], dated 22.7.13 will get the benefit of maternity leave for a maximum period of 180 days and 42 days of such leave in case of abortion / miscarriage.

During the period of such leave female contractual employee will get contractual remuneration as per terms and conditions of contract.

This order takes effect from 1s July, 2017.

MEMORANDUM


In this department Memorandum No. 6535-F(P) dt. 01.09.2015 it has been mentioned that no leave will be granted to any employee commencing from a date before 2 September, 2015 and continuing thereafter excepting on the grounds as mentioned in the Memorandum No. 2013-F(P) dt. 06.03.2012. It has also been mentioned there that in such case the entire period of absence will be treated as dies non and no salary will be admissible.


Now confusion has arisen, if this will be applicable in case of already sanctioned leave like Child Care Leave, Maternity Leave, Earned Leave ete. In this connection, attention is drawn that in the said order dt. 01.09.2013 it has also been mentioned that absence will be treated as dies non and salary will not be admissible unless the same is covered by the grounds in Finance Department Memorandum No. 2013-F(P) dt. 06.03.2012 where one such ground is that the provision will not apply in case of employees who had been on leave continuing from before.


Now, to remove the confusion it is clarified that absence will not be treated as dies non and no salary will be deducted or treated to be inadmissible in case of leave like Child Care Leave, Maternity Leave, Earned Leave, etc. sanctioned before the date of issuance of Finance Department's order No.6535-F(P) dated 1.9.2015

In terms of Finance Department Memo No. 1146-F(P), dated 14.02.2011 a female State Government may be granted Maternity Leave for a maximum of 180 days.

After issuance of the above mentioned order, a question has been raised as to whether a female Government Employee who was on Maternity Leave from a date earlier than 01-01-2011 (i.e. effective date of above mentioned order ) and such leave is continuing on or after 01-01-2011 without break, is entitled to Maternity Leave for a maximum of 180 days.

After careful consideration of the matter the Governon has been pleased to clarify that a female Government Employee who was on Maternity Leave from a date earlier than 01-01-2011 and such leave is continuing on or after 01-01-2011 without break is entitled to Maternity Leave for a maximum period of 180 days on existing tems and conditions as stipulated in Finance Department Memo No.1146 -F(P) , dated 14-02-2011.

The matter of enhancement of the ceiling of Maternity Leave on the recommendation of the Fifth pay Commission has been under active consideration of the Government for some time past. At present a female State Government employee is entitled to Maternity Leave for 135 days in terms of Rule 199 of West Bengal Service Rule, Part-I read with Finance Department Memo No. 3453-F dt 28.03.01.


After careful consideration of the matter the Governor has been pleased to decide that a female State Government employee may be granted Maternity Leave for a maximum of 180 days subject to the existing terms and conditions as laid down in Rule 199 of the West Bengal Service Rule, Part-I.


This order shall take effect from 01.01.2011.


Necessary amendments of the relevant Rules will be made in due course.
