Rule 173 (1) of West Bengal Service Rules Part 1

অর্ধবেতন ছুটি (Half-pay leave)


 👉কর্মচারীর এক বছর চাকরিকাল সম্পূর্ণ হলে ২০ দিন অর্ধবেতন ছুটি তার লিভ অ্যাকাউন্টে জমা হয়। এখানে বছর বলতে বােঝায় ৩৬৫ দিন ধরুন, একজন কর্মচারী ১০ এপ্রিল চাকরিতে যােগদান করেছেন, পরের বছর ১০ই এপ্রিল তাঁর অর্ধবেতন ছুটির অ্যাকাউন্টে ২০ দিন ছুটি জমা হবে। ১.৭.২০০১ থেকে প্রতিটি কর্মচারীর হাপ পে লিভ অ্যাকাউন্টে প্রতি বছর ১ জানুয়ারি ১০ দিন অগ্রিম হাফ পে লিভ জমা হবে এবং ১ জুলাই অগ্রিম ১০ দিন হাফ পে লিভ জমা হবে। এখানে উল্লেখ্য, ১ ক্যালেন্ডার মাস সম্পূর্ণ চাকরি হলে প্রতি মাসের জন্য ৫/৩ দিন ছুটি জমা হবে। যদি কেহ ১ জানুয়ারি চাকরিতে যােগদান করেন সেক্ষেত্রে ১ জানুয়ারি তাঁর অর্ধবেতন ছুটি জমা হবে ১০ দিন; কিন্তু যদি তিনি ২ জানুয়ারি চাকরিতে যােগদান করতেন সেক্ষেত্রে অগ্রিম অর্ধবেতন ছুটি জমা হত ৮.৩৩ দিন অর্থাৎ ৮ দিন (Fraction of the day shall be rounded off in the nearest day)। (G.O. 👉যেখানে অনুপস্থিতি অথবা সাসপেনশান সময়কালটি ডাইস-নন হিসাবে গণ্য হয়, সেখানে তা বছরের যে অর্ধে হবে অর্থাৎ জানুয়ারি থেকে জুনের মধ্যে অথবা জুলাই থেকে ডিসেম্বরের মধ্যে তার পরের অর্ধে ডাইস-নন সময়কালের জন্য ১/১৮ অংশ বাদ দিয়ে জমা হবে। কিন্তু কোনাে অবস্থায় ১০ দিনের বেশি বাদ যাবে না। ধরুন, একজন কর্মচারী ১৪৫ দিন সাসপেনশানে ছিলেন ১০ জানুয়ারি থেকে। এক্ষেত্রে ৮ দিন অর্ধবেতন ছুটি বাদ যাবে। পরবর্তী অর্ধে অর্থাৎ ১ জুলাই তার হাফ পে লিভ অ্যাকাউন্টে জমা হবে ১০ দিনের পরিবর্তে ২ দিন। কিন্তু যদি ২০৫ দিন সাসপেনশানে থাকতেন সেক্ষেত্রে বাদ যেত ১১ দিন। ফলে এক্ষেত্রে জুলাই মাসে হাফ পে লিভ অ্যাকাউন্টে কোনাে ছুটি জমা হত না।


👉এই ছুটি জমানাের ঊর্ধ্বসীমা নেই। যদি কারাে ৩৬ বছর চাকরি হয় সেক্ষেত্রে তিনি যদি কোনাে অর্ধবেতন ছুটি না নিয়ে থাকেন, তাহলে তাঁর লিভ অ্যাকাউন্টে ৭২০ দিন অর্ধবেতন ছুটি জমা থাকবে।


 👉এই ছুটি ব্যক্তিগত প্রয়ােজনে এবং মেডিকেল গ্রাউন্ডে নেওয়া যায়। 

 👉অস্থায়ী কর্মচারীরা অর্ধবেতন ছুটি পেতে পারেন যদি কর্তৃপক্ষ এই ছুটি অনুমােদনের সময় নিঃসংশয় হন যে, ছুটি শেষ হবার পর তিনি কাজে যােগদান করবেন। কিন্তু যদি কোনাে অস্থায়ী কর্মচারী মেডিকেল বোের্ড দ্বারা কাজের অনুপযুক্ত বলে ঘােষিত হন, সেক্ষেত্রে কাজে যােগদানের প্রশ্ন ওঠে না। স্থায়ী কর্মচারীদের ক্ষেত্রে এইরকম কোনাে নিয়ম নেই। i 

👉ক্যাজুয়েল লিভ ছাড়া অর্ধবেতন ছুটির সঙ্গে যে-কোনাে ছুটি নেওয়া যায়। (Rule 167)


কমিউটেড লিভ (Commuted Leave)



➡️কমিউটেড লিভ বলতে বােঝায় দুটি অর্ধবেতন ছুটির বিনিময়ে ১ দিনের পূর্ণবেতন ছুটি। নিম্নলিখিত ক্ষেত্রে এই ছুটি অনুমােদন করা যায়। 

➡️কর্মচারীর যতদিন পর্যন্ত হাফ পে লিভ জমা থাকে তার অর্ধেক পরিমান কমিউটেড লিভ নিতে পারেন ৷

➡️কমিউটেড লিভ কর্মচারীর নিজের চিকিৎসার জন্য মেডিকেল সার্টিফিকেটের ভিত্তিতে অনুমােদিত হয়ে থাকে ৷

 ➡️অনুমােদিত পাঠ্যক্রম বিষয়ে জনস্বার্থে পড়াশােনার জন্য চাকরি জীবনে ৯০ দিন পর্যন্ত কমিটেড লিভ মেডিকেল সার্টিফিকেট ছাড়া অনুমােদন করা যায়। 

➡️ মাতৃত্বকালীন ছুটি শেষ হবার পর ওই ছুটির সঙ্গে মহিলা সরকারি কর্মচারী মেডিকেল সার্টিফিকেট ছাড়া অথবা সদ্যোজাত সন্তানের অসুস্থতার কারণে যদি তার কাছে মায়ের উপস্থিতি একান্ত প্রয়ােজন হয় এই সংক্রান্ত মেডিকেল সার্টিফিকেট দাখিল করেন, তাহলে ৬০ দিন পর্যন্ত যে-কোনাে ছুটি এমনকি কমিউটেড লিভ নিতে পারতেন Rule 199 W.B.S.R.-I অনুযায়ী। তা এখন বেড়ে হয়েছে এক বছর পর্যন্ত, যে-কোনাে লিভ এমনকি কমিউটেড লিভ নিতে পারেন G.O. No. 2658 dt. 1.3.2002 অনুযায়ী।

➡️ছুটি অনুমােদনের সময় ছুটি অনুমােদনকারী কর্তৃপক্ষ যাদ নিঃসংশয় হন যে, কমচারী ছুটি শেষ হবার পর তাঁর কাজে যােগদান করার যথেষ্ট সম্ভাবনা আছে তবেই ছুটি মঞ্জুর করতে পারেন। 

➡️কমিউটেড লিভ অনুমােদনের পর চাকরিতে যােগদান না-করে যদি কেউ চাকরিতে ইস্তফা দেন অথবা স্বেচ্ছায় অবসর গ্রহণ করেন, সেক্ষেত্রে ওই কমিউটেড লিভের সম্পূর্ণ ছুটিটি অর্ধবেতন ছুটি হিসাবে গণ্য হবে। যদি কমিউটেড লিভ হিসাবে পূর্ণবেতন প্রদান করা হয়ে থাকে, তাহলে অর্ধবেতন ছুটি হলে যে টাকা হত তা আদায় করতে হবে।


 ➡️মেডিকেল বাের্ড দ্বারা যদি কোনাে কর্মচারী স্বাস্থ্যের কারণে কাজের অনুপযুক্ত হিসাবে ঘােষিত হন এবং কমিউটেড লিভ শেষ হবার পর চাকরিতে যােগদান না করতে পারেন অথবা কমিউটেড লিভে থাকাকালীন যদি কর্মচারীর মৃত্যু হয়, সেক্ষেত্রে টাকা আদায়ের প্রয়ােজন হবে না। (Rule 173)

  ➡️সরকারি বিদ্যালয়ের শিক্ষক/অশিক্ষক কর্মচারীরা ব্যক্তিগত প্রয়ােজনে চাকরি জীবনে ৬০ দিন অর্ধবেতন ছুটির বিনিময়ে ৩০ দিন কমিউটেড লিভ নিতে পারেন। (G.O. No. 769-F dt.13.7.95)


Half-pay leave and commuted leave.


Rule 173. (1) (a) A Government employee shall be entitled to half-pay leave for 20 days in respect of each completed year of service. (b) The leave under clausė (a) may be granted on medical certificate or on private affairs:


Provided that in the case of a Government employee not in permanent employ no half-pay leave may be granted unless the authority competent to grant leave has reason to believe that the Government employee will return to duty on its expiry except in the case of a Government employee who has been declared completely and permanently incapacitated for further service by a competent medical authority.


(2) If a Government employee is on leave on the day on which he completes a year of service, he shall be entitled to half-pay leave without having to return to duty.


(3) Commuted leave not exceeding half the amount of half-pay leave due may be granted on medical certificate to a Government employee subject to the conditions that


(a) the authority competent to grant leave is satisfied that there is reason able prospect of the Government employee returning to duty on its expiry;


(b) when commuted leave is granted, twice the amount of such leave shall be debited against the half-pay leave due;


(c) the authority competent to grant leave obtains an undertaking from the Government employee that in the event of his resignation or retiring voluntarily from service he shall refund the difference between the leavesalary drawn during commuted leave and the leave-salary admissible during half-pay leave;


(d) half-pay leave up to a maximum of 180 days may be allowed to be commuted during the entire service (without production of medical certificate) where such leave is utilised for an approved course of study certified to be in public interest by the leave sanctioning authority.


Note:

**A bond as in case of study leave under Appendix 5 is to be executed by the temporary/permanent Government employee as the case may be.


*(4) Where a Government employee who has been granted commuted leave resigns from service or, at his request, is permitted to retire voluntarily without returning to duty, the commuted leave shall be treated as half-pay leave and the difference between the leave salaries in respect of commuted leave and halfpay leave shall be recovered:


Provided that no such recovery shall be made if the retirement is by reason of ill health incapacitating the Government employee for further service or if the Government employee dies while on commuted leave.

 Leave Rules সাধারন নিয়মাবলী Leave rules ➡️ যে সমস্ত সরকারী কর্মচারী চাকরী থেকে dismiss বা remove করা হয়েছে , কিন্তু appeal বা revision এ পুনঃবহাল হয়েছেন তারা আগেকার চাকরীর ছুটি পাওয়ার যোগ্য। ➡️ কোনো সরকারী কর্মচারী যদি অন্য দপ্তরে আবেদন করেন (অন্য অফিস বা Department) সেই আবেদন যদি Through Proper Channel করা হয়ে থাকে তবে সেক্ষেত্রে তার পূর্ববর্তী service এর leave Count করা হবে। ➡️ ছুটি কর্মচারীর অধিকারের মধ্যে পাড়ে না। ➡️ ছুটি চলাকালীন কোনো কর্মচারীকে ছুটি থেকে Recall ও করা যেতে পারে ৷ ➡️ যে সব কর্মচারী medical Certiticate এ ছুটিতে আছেন তাকে join করার আগে Fitness Certificate দাখিল করতে হবে। ➡️ কোনো সরকারী কর্মচারী একটানা ৫ বছরের অধিক ছুটিতে থাকতে পারবে না ৷ ( R.34) ➡️ ইচ্ছাকৃত অনুপস্থিতির জন্য কর্মচারীর বিরুদ্ধে disciplinary action নেওয়া হতে পারে ৷ ➡️ বিশেষ কারণে কোনো ছুটিতে থাকা  কর্মচারীর ১৪ দিন পর্যন্ত retrospectively বর্ধিত করা হতে পারে। *A Government employee who is dismissed or removed form the public service, but is reinstated on appeal or revision is entitled ot count...
