সাধারন নিয়মাবলী

Leave rules

  • ➡️ যে সমস্ত সরকারী কর্মচারী চাকরী থেকে dismiss বা remove করা হয়েছে , কিন্তু appeal বা revision এ পুনঃবহাল হয়েছেন তারা আগেকার চাকরীর ছুটি পাওয়ার যোগ্য।
  • ➡️ কোনো সরকারী কর্মচারী যদি অন্য দপ্তরে আবেদন করেন (অন্য অফিস বা Department) সেই আবেদন যদি Through Proper Channel করা হয়ে থাকে তবে সেক্ষেত্রে তার পূর্ববর্তী service এর leave Count করা হবে।
  • ➡️ ছুটি কর্মচারীর অধিকারের মধ্যে পাড়ে না।
  • ➡️ ছুটি চলাকালীন কোনো কর্মচারীকে ছুটি থেকে Recall ও করা যেতে পারে ৷
  • ➡️ যে সব কর্মচারী medical Certiticate এ ছুটিতে আছেন তাকে join করার আগে Fitness Certificate দাখিল করতে হবে।
  • ➡️ কোনো সরকারী কর্মচারী একটানা ৫ বছরের অধিক ছুটিতে থাকতে পারবে না ৷ ( R.34)
  • ➡️ ইচ্ছাকৃত অনুপস্থিতির জন্য কর্মচারীর বিরুদ্ধে disciplinary action নেওয়া হতে পারে ৷
  • ➡️ বিশেষ কারণে কোনো ছুটিতে থাকা  কর্মচারীর ১৪ দিন পর্যন্ত retrospectively বর্ধিত করা হতে পারে।

  • *A Government employee who is dismissed or removed form the public service, but is reinstated on appeal or revision is entitled ot count his former service for leave. R.147(2)
  • * Where a Government employee applies for another post under this Government but outside his parent office or department and if such application is forwarded through proper channel and the applicant is required to resign his post before taking up the new one, such resignation shall not result in the lapse of leave at his credit. R.147(4)
  • * Leave cannot be claimed as of right. R.151(1).
  • * Authority can recall a Government employee before the expiry of leave. R.158.
  • *No Govt. employee who has been granted leave on medical certificate can not return to duty without submitting fitness certificate. R.159
  • * Leave may be restrospectively extended up to a maxmimum 14 days on certain conditions. R.161
  • *Prefixing and affixing

➡️ ছুটি শুরুর আগের দিন বা ছুটি শেষ হওয়ার পরের দিন যদি রবিবার বা অন্যকোনো সরকারী ছুটি থাকে তাহলে কর্মচারীকে এইদিন গুলিকে affix বা Suffix করার অনুমতি দেওয়া যেতে পারে।

When the day immediately following the day on which a Government employee's leave expires is a Sunday or holiday or one of series of holidays, the Government employee may be allowed to prefix or affix such Sunday or holiday(s), subject to the condition that he was otherwise fit to resume his duties before commencement or on expiry of his leave as the case may be but for Sunday or holidays. No prefixation or affixation should be allowed unless the aforesaid condition is fulfilled. R.151(3)

special Disablity Leave

R.195

  • * Special disability leave may be granted to a Government employee whether permanent or temporary, who is disablede by injury intentionally inflicted or caused in, or in consequece of the due performance of his official duties or in consequence of his official position.
  • * Certificate of medical board is necessary for granting of this kind of leave.
  • * Such leave can be combined with any other kind of leave.
  • * Maximum period for such leave 24 months of any one disability.
  • * Such leave shall be counted as duty in calculating service for pension and shall not be debited against the leave account.
  • *Special Disability Leave may be granted by the Secretaries in-charge of the Administrative Departments in favour of the employees under their administrative control after being personally staisfied that the necessary conditions and criteria for the grant of such of leave as laid down elsewhere in the rules are fulfilled and the facts being recorded in writing.  R.150



Half-pay leave and commuted leave

  • ➡️ Half pay leave বছরে দুবার করে ১০ দিন করে অগ্রীম যোগ করা হয় - জানুয়ারী ও জুলাই মাসের প্রথম দিন অর্থাৎ একটি ক্যালেন্ডার বছরে মোট ২০ দিন ৷
  • ➡️ প্রতিটি কালেন্ডার মাসের জন্য ৫/৩ হারে এই leave যোগ করা হয় ৷
  • ➡️ Medical Certificate দাখিল করে বা ব্যক্তিগত প্রয়োজনে এই ছুটি নেওয়া যেতে পারে ৷ তবে এক্ষেত্রে দ্বিগুন পরিমান Half Pay leave কেটে নেওয়া হয়।
  • ➡️ সম্পূর্ন চাকরী জীবনে সর্বাধিক ১৮০ দিন Commute করা যেতে পারে।
  • * Half-pay leave credited into leave account twice a year in two installments ten days each - 1st day of January and July.
  • * The leave shall be credited to leave account of the employee @ 5/3 days for each completed calender month which a Government employee is likely to render in the half-year of the calendar year.
  • * A Govt. employee shall be entitled to half-pay leave for 20 days in respect  of each completed year of service. R.173(1)
  • * commuted leave not exceeding half the amont of half-pay leave due may be granted on medical certificate to a Govt. employee subject to the conditions. R.173 (3)
  • *When commuted leave is granted, twice the amount of such leave shall be debited against the half-pay leave due. R.173(3)(d)


Casual Leave

R.207

  • ➡️ CL অন্য কোনো ছুটির সঙ্গে Combine করা যায় না।
  • ➡️ এক ক্যালেন্ডার বছরে সর্বোচ্চ ১৪ দিন এই ছুটি পাওয়া যায়।
  • ➡️ রবিবার বা অন্য ছুটির দিন সহ একটানা ৭ দিনের বেশী এই ছুটি পাওয়া যায় না।
  • *Casual leave which is not recognised as leave under these rules shall not be combined with any other kind of leave admissible under these rules. R,167(1)
  • * Govt. employee on casual leave shall not be treated as absent from duty.
  • * CL granted for any calender year shall not exceed 14 days.
  • * Such leave shall not allow employee absence of more than 7 consequtive days at a time including Sundays, holidays or Weekly off days except for very special circumstance to be recorded in writing :
  • Provided that Sundays, holidays and weekly offs preceding, following or falling within the period of CL shall not be counted as part of the casual leave.



Earned Leave

  • ➡️ এই প্রকার ছুটি বছরে দুবার অগ্রীম Credit করা হয় - ১৫ দিন করে একবার জানুয়ারী ও জুলাই এ ৷ ( vacation Dept. ছাড়া ৷
  • ➡️ সর্বোচ্চ একবারে ১২০ দিন পর্যন্ত EL পাওয়া যায়।
  • ➡️ সর্বোচ্চ ৩০০ দিনের Encashment পাওয়া যায়।

  • ➡️ কোনো কর্মচারী ইস্তাফা দিলে cash equivalent এর পেতে পারেন ৷ এক্ষেত্রে সর্বোচ্চ সীমা ১২০ দিন।
  • * Earned leave shall be credited to the leave account of a Government employee @ 5/2 days for each completed calender month of service which he is likely to render in a half-year of the calender year in which he is appointed. R170(1)
  • * The leave account of govt. employee shall be credited with EL in advance in two installments of 15 days each on the 1st day of January and July. (other than vacation department ) R.169(1).
  • *Cash equivalent to EL shall be calculated as follows and shall be payable in one lump sum as one time settlement.

Cash equivalent =

( Last pay including DA & HRA /30 ) x Number of unutilised EL maximum 300 days

R.168A(2)(b)(i)

* If a Government employee resigns or quits service, he is entitled for cash equivalent to EL subject to a maximum of 120 days. R.168A (4) (ii)

 Extraordinary leave

নিম্নলিখিত শর্তে এই ছুটি পাওয়া যেতে পারে -

  • ➡️ যখন অন্য কোনো ছুটি admissible নয়
  • ➡️ কর্মচারী এই ছুটির জন্য লিখিত ভাবে আবেদন জানাই।
  • ➡️ অস্থায়ী কর্মচারীরা সর্বোচ্চ ৩ মাস পর্যন্ত এই ছুটি পেতে পারেন।
  • ➡️ শর্তসাপেক্ষ এই ছুটি ৩ মাসের অধিক পাওয়া যেতে পারে স্থায়ী কর্মচারীর ক্ষেত্রে।

* Extraordinary leave may be granted :-

  • (a) when no other leave is admissible
  • (b) when other leave is admissible, but the Government employee applies in writing for the grant of extraordinay leave   R.175(1)
  • * It can be granted more than 3 months subject to the conditions.

Quarantine Leave

  • নীচে দেওয়া কয়েকটি রোগের কোনো কার্মচারীর যদি পরিবারের কেউ আক্রান্ত হয়ে থাকে ও তার উপস্থিতি অন্য কার্মচারীদের ক্ষেত্রে বিপজ্জনক মনে হয় তবে এই প্রকার ছুটি দেওয়া যেতে পারে।
  • কোনটি Infectious disease তা নির্ধারন করবে  Medical officer  বা Public Health officer 
  • Medical officer  বা Public Health officer এর Certificate দাখিল করে সর্বোচ্চ ২১ দিন ও বিশেষ কয়েকটি ক্ষেত্রে ৩০ দিন পর্যন্ত পাওয়া যেতে পারে।
  • বর্তমানে এই প্রকার ছুটিতে সংশোধন করা হয়েছে ও আরও কয়েকটি রোগ যোগ করা হয়েছে। ( সূত্র No. 3230-F(P1 ). Dated, the 18th November, 2020.)

নীচে রোগগুলির বর্ণনা দেওয়া হল।⬇️


R.198

  • * In consequence of the presence of an infectious disease, referred to below mentioned in family of household  of a Govt. employees at his place of duty, residence or sojourns, his attendance at his office is considered as hazardous to the health of other Government employees, such Government employee may be granted qurantine leave.
  • ➡️* Small-pox may be considered as infectious disease though chicken-pox shall not (unless considered so by Medical Officer or Public Health Officer)
  • ➡️* The following diseases shall also be treated as infectious for the purpose of grant of Quarantine leave- Scarlet Fever, Plague (Bueekmonic or bubonic), Typhus, Cerebro-spinal meningitis
  • ➡️* For persons employed in the preparation and distribution of food, the following additional diseases shall also be treated as infectious - Dysentery, Enteric fever (Typhoid fever), Malta Fever, Paratyphoid fever
  • * Such leave may be granted by the head of office on the certificate of a Medical Officer or Public Health Officer for a period not exceeding 21 days or, in exceptional circumstances, 30 days.
  • This rule is modified vide order dt. No. 3230-F(P1 ). Dated, Howrah, the 18th November, 2020. 
  • Below mentioned diseases are included  in this leave-
  • 1. SARS 
  • 2. MARS 
  • 3. COVID-19 
  • 4. Avian Influenza (H5N1) / Novel Influenza 
  • 5. Crimean Congo Haemorrhagic Fever (CCHF)


Maternity Leave

  • 👉 মাতৃত্বকালীন ছুটি বা Maternity Leave আগে ছিল ১৩৫ দিন বর্তমানে এটি বর্ধিত করে সর্বাধিক ১৮০ দিন করা হয়েছে।
  • 👉 মাতৃত্বকালীন ছুটির সময় কালকে Dies non হিসাবে বিবেচনা করা হবে ও এই সময়কালকের ছুটিকে সবেতন ছুটি হিসেবে গণ্য করা হবে।
  • 👉 রাজ্য সরকারের contractual কর্মীদের ক্ষেত্রেও এটি প্রযোজ্য হবে।
  • 👉 Abortion বা Miscarriage এর ক্ষেত্রে ছুটির সর্বাধিক পরিমান ৪২ দিন ৷


 


 Paternity leave


পিতৃত্বের ছুটি সহ শিশু যত্নের ছুটি:

  •  👉শুধুমাত্র পুরুষ সরকার  ৩০ দিনের জন্য দুই সন্তানের যত্ন নেওয়ার জন্য পেতে পারেন।
  •  👉এই ছুটি প্রসবকালীন সময়ে এবং সন্তানের 18 বছর বয়স পর্যন্ত নেওয়া যেতে পারে।

  •  👉এই ধরনের ছুটি অন্য যে কোনও ধরণের ছুটির সাথে combine করা যেতে পারে।




Child Care Leave

No.1364-F(P) dt.15.02.12

  • ➡️ মহিলা সরকারী কর্মচারীরা সর্বাধিক ২ সন্তানের দেখাশোনার জন্য সর্বোচ্চ ৭৩০ দিনের ছুটি পেতে পারেন ৷ (সম্পূর্ণ চাকরী জীবনে )
  • ➡️ এই ছুটি পাওয়ার জন্য সন্তানের বয়স ১৮ এর মধ্যে হতে হবে।
  • ➡️ যে কোনো বছরে ৩টি পর্যায়ে একজন এই ছুটি নিতে পারেন ৷
  • ➡️ এই ছুটি একটি পর্যায়ে ১৫ দিনের অধিক হতে হবে।

  • *Female Government employees having minor children may be granted Child Care Leave (CCL) by an authority competent ot grant leave for a maximum period of two years i.e 730 days during their entire service period for taking care up to two children up to 18 years of their age whether for rearing or to look after any of their needs like examination, sickness etc.
  • * It may not be granted in more than 3 spells in a calendar year.
  • * It may not be granted for less than 15 days in a spell.
  • * Not to be granted during probation period unless extreme situation arise.

Hospital Leave

R.200

Hospital leave means leave on account of ill health granted to specified members of subordinate services whose duties expose them to special risk of accident or illness.

Study Leave

  • Study leave may be granted to a Government emplyeee with due regard to the exigencies of public service to enable him to undergo, in or out of West Bengal /India, a special course of study consisting of higher studies of specialised training in a professional or a technical subject having a direct and close connection with the sphere of his duty.
  • * Employess has been for less than 5 years in service not eligible for such leave.
  • * Maximum period for such leave ordinarily 12 months at any one-time and 24 months in entire service.

Leave not due

এই প্রকার ছুটি স্থায়ী বা অস্থায়ী কর্মচারীরা পেতে পারেন নিম্নলিখিত শর্তে --

  • ➡️সংশ্লিষ্ট সংস্থা এটা বিশ্বাস করেন যে ছুটির পরে কর্মচারী ছুটি শেষ হওয়ার পর পুনরায় join করবেন ৷
  • ➡️ এই প্রকার ছুটি কর্মচারী ভবিষ্যৎে যে পরিমান Half pay leave অর্জন করবেন তার উপর সীমাবদ্ধ থাকবে।
  • ➡️ এই প্রকার ছুটি সম্পূর্ন চাকরী জীবনে সর্বোচ্চ ৩৬০ দিন, একটানা ৯০ দিন ও medical Certificate  দাখিল করে টানা ১৮০ দিন পর্যন্ত পাওয়া যেতে পারে।

Casual leave and special Casual Leave

 Casual leave Rule  207 . A Government employee on casual leave is not treated as absent from duty and his pay during such leave is not interrupted. Casual leave shall not, however, be given so as to cause an evasion of the rules regarding (1) date of reckoning allowance - Rule 26; (ii) charge of office - Rule 28; or so as to extend the term of any leave beyond the time admissible by rule.   No. 6112 F (P2) dated 09.11.2023  List of Public holidays 2024 In exercise of the power conferred by the explanation to Section 25 of the Negotiable Instrument Act, 1881 (XXVI of 1881), read with Government of India, Ministry of Home Affairs, Notification No. 20/25/56-pub(l) dated the 8" June, 1957, the Governor is pleased to declare the days as specified at List I below to be Public Holidays during the year 2024. 2. The Governor is also pleased to notify that the offices under the Government of West Bengal with the exception of the offices of the Registrar of Assurances, Kolkata and Collector of the Stamp Revenue, Kolkata shall be closed on the days as specified at List II below which are not declared to be public holidays, during the year 2024. 3.
